Can You Go to Jail for a First DUI in Illinois?

Yes, you can go to jail for even a first DUI charge in Illinois. It is a Class A misdemeanor, and the court has authority under 625 ILCS 5/11-501 to order up to 364 days in county jail, even on a first offense. While it is less common for a first-time offender to be sentenced to that maximum, it is possible to still be given a jail sentence, and knowing the implications can help you be prepared.

The Court’s Authority Is Real

One of the biggest mistakes you can make if you’ve just been arrested for your first DUI is to assume that you’ll get the lightest punishment. Approval of negotiations or sentencing decisions are at the discretion of the court. Although the court tends to be more gracious with first-time offenders, it’s not a legal shield that absolves you from the consequences of the law.

The court can always issue the full first-DUI penalties if it chooses to do so. With strong legal defense, you’ll have a better chance of avoiding the worst possible punishments.

  • Minor passenger in the vehicle: Any child under the age of 16 in the vehicle with you at the time is grounds for elevating a misdemeanor DUI to a felony DUI. Even where the prosecution decides not to charge a felony, the judge may require jail as part of accepting a negotiated plea.
