How Much Does a DUI Lawyer Cost in Illinois?

Aug 25, 2026 by The Conner Law Firm

Like many of the people who unfortunately are having to consider the cost of DUI representation, attorneys price their time at what value they provide and what the market supports. An attorney who takes your case for a nominal fee doesn’t believe their time (considering their experience and proven abilities) brings enough value to their clients to justify charging a rate that the market supports.

The short of it: You get what you pay for. A bicycle is cheaper than a Volvo for a reason.

Some firms can charge $1000 on your case, because they are only going to appear in court one time, get you the initial offer, and walk you through to plead to an offer you probably could have gotten yourself. A firm that is going to leverage relationships, advocate for offers outside of your court dates, and scrutinize every piece of evidence against you for weaknesses is worth a premium, and that’s why our firm doesn’t attempt to compete on low-price business models.

What Actually Drives the Number?

The cost for a Belleville DUI defense lawyer is driven by several key factors.

Level of Charge

A first-time misdemeanor DUI has a different fee than a felony Aggravated DUI involving Death, and there are good reasons for that. With added consequences of conviction, mountains of materials that must be reviewed, and more court appearances on the case, more time and effort are necessary to try and achieve an acceptable outcome or prepare for trial.

Prior Records and Enhancements

A clean record generally calls for a more standard defense strategy, while a criminal history raises the stakes and changes the calculus. When you’re facing standard first-time DUI, the goal is to try to reduce charges, have them dismissed, or seek court supervision. A repeat offender or even a first-time offender with an aggravated DUI has a lot more to lose, with the court or prosecution much less willing to take a chance and offer a golden deal or reduction in charge, Lawyers scale their fees based on the level of work involved in the defense.

Facts of the Arrest

DUI defense lawyers must review other factors such as if you had an accident that caused someone else injury or death, a high BAC, refusal to take a breathalyzer, or any other circumstances. Refusing to take the test does help defense in the criminal case in that it doesn’t hand the State a test score, though it makes the administrative battle longer.

Litigation of the Statutory Summary Suspension

While your criminal case is in the works, so too is your administrative process against your driver’s license. This runs even if you beat your criminal charges. Choosing not to fight the suspension means your lawyer has a lower workload, though contesting this suspension requires them to litigate a petition to rescind, which results in an evidentiary hearing generally within 30 days of filing. The Conner Law Firm litigates the administrative proceedings, if necessary, as part of the pre-trial fee. Some firms will charge a fee for the hearing separate from general representation.

Likelihood of Going to Trial

The biggest factor that impacts costs is whether you choose to negotiate a plea deal or go for trial. Most DUI cases will resolve through plea negotiations or pre-trial motions to suppress evidence. If your case cannot be resolved short of trial, additional expenses like expert reports, expert testimony fees, a trial fee from the attorney, and other administrative fees may apply. Going to trial adds to the workload our firm will undergo to protect your interests, and takes us away from representation of other clients in the first phase of their case, which adds to the cost through the trial fee.

DUI Fees Are Usually Structured

Representation can be structured in many ways. Some firms will charge a flat fee for representation from first appearance through trial. Our firm breaks that fee down into what we think is fairer to the client and has a cost more aligned with the work required to achieve the outcome you are seeking from your case. Our standard engagement agreement has both a pre-trial and trial fee, where the trial fee isn’t due until we have exhausted our attempts to achieve an acceptable outcome, typically upon the filing of motions immediately preceding trial.

Whatever firm you discuss your case with: Representation should come with a clear, written fee agreement that you understand. Whether the fee is staged by phase of the case, whether the administrative proceeding is part of the representation, and who is responsible for fees related to report and expert appearances are all something that should be addressed. As medical records are becoming an issue in more cases, cost of medical record collection, chemical testing analysts, and other investigations should be addressed.

The Comparison That Matters

Cost may feel like a sticking point until you weigh all of the consequences that come with a DUI in Illinois beyond the criminal penalties and fines. Jobs that require you to drive or have a professional license may relieve you of your duties, and that can affect your future earning capacity when you can’t work in your field again.

Focusing on the cheapest way out of this situation may mean you wind up taking the less attractive option, and that could leave you with the permanent record consequence. Losing your driving privileges as well as not being able to drive to work are other concerns. If you’re wondering, do I need a lawyer for a first DUI in Illinois, the answer is that legal representation is the only viable option protect your rights and have a chance at a more favorable outcome.
